1. Acceptance of Terms

These Terms of Service (the “Terms”) govern your access to and use of the websites, content, and services offered by Willow Creek Meditation (“Willow Creek,” “we,” “us,” or “our”). By accessing or using our services, you agree to be bound by these Terms and our privacy practices. If you do not agree, you must not use the services.

You represent that you have the authority to accept these Terms on your own behalf or on behalf of an organization. If you use the services on behalf of an organization, you agree to these Terms for that organization and warrant that you have the authority to bind the organization to these Terms.

2. Eligibility and Accounts

2.1 Age requirements

You must be at least 16 years old, or the age of majority in your jurisdiction if higher, to use the services. If you are under 18, you may use the services only with the consent and supervision of a parent or legal guardian who agrees to be bound by these Terms.

If you submit content (such as feedback or practice notes), you grant Willow Creek a worldwide, non‑exclusive, royalty‑free license to use, reproduce, modify, and display such content solely for operating, improving, and promoting the services. You represent that you have all rights necessary to grant this license.

4.2 Our content

The services, including guided audio, text, videos, interfaces, visual designs, logos, and code, are owned by or licensed to Willow Creek and protected by intellectual property laws. Except as expressly permitted, you may not use, copy, modify, or create derivative works based on the services.

4.3 Feedback

You may provide suggestions or feedback. You grant us an irrevocable, worldwide, perpetual, royalty‑free license to use such feedback without any obligation to you.

5. Health Disclaimer

Willow Creek offers mindfulness and meditation guidance for educational and wellness purposes only. We do not provide medical advice and our content is not intended to diagnose, treat, cure, or prevent any disease. Always seek the advice of your physician or other qualified healthcare provider with questions about a medical condition. If you experience dizziness, anxiety, or discomfort during practice, discontinue and consult a professional.

6. Payments and Subscriptions

Certain features may be offered for a fee or subscription. Prices are subject to change. If you purchase a subscription, it will renew automatically at the end of each term unless canceled in accordance with the cancellation policy presented at checkout.

  • Taxes may be added as required by law.
  • Refunds, if any, are issued in accordance with the policy stated at the time of purchase.
  • You authorize us to charge your payment method for the applicable fees and any taxes.

7. Third‑Party Links and Services

The services may contain links to third‑party websites or services. We do not control and are not responsible for the content, policies, or practices of any third parties. Your interactions with third‑party services are solely between you and the third party.

8. Termination

We may suspend or terminate your access to the services at any time, with or without notice, if we believe you have violated these Terms or for any other reason. You may stop using the services at any time. Upon termination, your right to use the services will cease immediately.

9. Disclaimers and Limitation of Liability

9.1 No warranties

The services are provided “as is” and “as available.” To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, and non‑infringement.

9.2 Limitation of liability

To the fullest extent permitted by law, Willow Creek and its affiliates, officers, employees, agents, and partners will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenues, data, or goodwill, arising from or relating to your use of the services.

9.3 Cap

Our aggregate liability for all claims relating to the services shall not exceed the greater of one hundred U.S. dollars (US$100) or the amount you paid us, if any, in the twelve months preceding the event giving rise to the claim.

10. Indemnification

You agree to indemnify and hold harmless Willow Creek and its affiliates, officers, agents, employees, and partners from and against any and all claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees and costs, arising out of or in any way connected with your access to or use of the services, your content, or your violation of these Terms.

11. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the jurisdiction in which Willow Creek is established, without regard to its conflict of laws principles. You agree to submit to the personal and exclusive jurisdiction of the courts located in that jurisdiction to resolve any dispute arising out of the Terms or the services.

12. Changes to Terms

We may update these Terms from time to time. If we make material changes, we will provide notice by posting the updated Terms and updating the “Last updated” date at the top of this page. Your continued use of the services after changes become effective constitutes your acceptance of the revised Terms.
